Family Law
The attorneys at CC Weaver & Associates understand that family law matters are often the most difficult legal matters our clients face. Our attorneys understand the complex dynamics that accompany family law situations. As always, we will serve as your zealous advocates, but also strive to maintain your family unit and relationships if you so desire.

Our attorneys can assist you in all types of family law matters including dissolution of marriage, division of community property, child custody and visitation, temporary and permanent child support, spousal support, and tax consequences of a dissolution of marriage.

In addition, our attorneys are trained to advise clients regarding legal and tax aspects of joint ownership of property, assist clients in the formation of family limited partnerships and limited liability companies for the management of property, and advise clients regarding directives for health care, use of durable powers of attorney, revocable living trusts, and various types of investments.

DISSOLUTION OF MARRIAGE
In California, a dissolution of marriage is a “no fault” concept. If either party is willing to testify that irreconcilable differences have entered into the marriage which have caused the irremediable breakdown of the marriage, a judgment of dissolution will be entered.

The process begins by filing a petition in the Superior Court of the county in which the parties have resided for at least three (3) months prior to the filing of the petition. The petition sets forth that irreconcilable differences have entered into the marriage and that there is no hope for reconciliation. Furthermore, the petition sets forth, if applicable, a request for spousal support, child support, attorney’s fees, costs, and/or a request that the community property be divided according to law.

If you are considering a dissolution of marriage, or have been served with papers, please contact the attorneys at CC Weaver & Associates. We will advise you as to all your options during this difficult time.
